1. RETURNS POLICY

1.1    Aussie Fleece will provide a refund or an exchange of products in accordance with the provisions of the Australian Consumer Law.

1.2    To obtain a refund or exchange of product, you must within 14 days of the date of purchase produce to Aussie Fleece a purchase

         receipt.

1.3    The product must be unused and in its original condition, clean and unspoiled.

1.4    Our staff will examine the product and determine whether a refund or exchange will be offered in accordance with this policy.

1.5    The return of any product to Aussie Fleece will be at your expense as we are unable to refund delivery costs.

1.6    Refunds are not provided if:

i.     There is a change of mind;

ii.    The wrong selection is made;

iii.   A cheaper product is found elsewhere.

         Please review your selection before finalizing your selection.

1.7    If a refund is granted, Aussie Fleece can take up to 14 days to issue the refund for any returned item.

1.8    Once a refund or exchange is granted, the product must be returned within 14 days from the date of acceptance of the refund or

         exchange.

1. 9   The cost of freight is deducted from the refund amount.

2. AGREEMENT

2.1    By using our website, you agree and acknowledge that you:

i.     Accept the terms and conditions of this agreement;

ii.    Have entered into a legally binding contract with Aussie Fleece;

iii.   The terms and conditions together with your Order constitute the entire agreement between you and Aussie Fleece for the

       supply of our products.

2.2    A minor that purchases an Aussie Fleece product will be deemed the agent of his or her

         parents or guardians for the purpose of this Agreement and Aussie Fleece reserves the right to take legal action and seek

         compensation from a minors parents or guardians for any loss or damage suffered by Aussie Fleece online as a result of any breach

         of this Agreement by a minor.

2.3    A contract for the sale and supply of products is made by you making an offer to buy a product at the advertised price via our

         website by:

i.     Making an electronic Order for a product via our website;

ii.    You confirming the Order in accordance with our website procedure;

iii.   The receipt of payment in full (including delivery charges) via our website; and

iv.   Our acceptance of the offer.

2.4    Communication of your offer via our website is deemed to have occurred when:

i.     The requirements of our terms and conditions have been meet;

ii.    The electronic instructions containing your offer is recorded  and stored on our database;

iii.   Confirmation is received in our database that payment has been received in full (including the delivery charge).

2.5    You acknowledge and agree that Aussie Fleece is not responsible for electronic instructions  not being received by reason of factors 

         beyond either parties reasonable control including but not limited to electronic or mechanical failure, software malfunction,

         computer or telecommunication failure, a hacking or malware event or the failure of third party website providers or systems.

2.6    To the extent permitted by law, Aussie Fleece is not liable to you in any way for any loss, damage or compensation however caused,

         arising directly or indirectly in connection with the use and transmission of electronic instructions via our website, or any failure to

         receive an electronic instruction for whatever reason.

2.7    Once the electronic instructions are processed and accepted, Aussie Fleece will process the Order without further consent from or

         reference to you.

3. ORDERS & PAYMENT

3.1    Aussie Fleece shall treat an electronic instruction as authentic and is under no obligation to verify the identity of the person or the

         persons authority to issue or transmit electronic instructions, or to verify the accuracy or completeness of those electronic

         instructions.

3.2    Upon receipt of the electronic instructions, Aussie Fleece will as soon as practicable after confirming your Order and payment, send

         you a confirmatory email. You may contact us via our website if you have a query in regard to your Order.

3.3    Aussie Fleece will contact you by email or telephone should your Order not be accepted and will arrange a full refund of any

         payment to you.

3.4    Subject to the terms and conditions herein, Aussie Fleece will try to have the product shipped out between 1 to 7 business days

         from the fulfillment of the Order.

3.5    Aussie Fleece has sole and absolute discretion to accept or reject any Order or offer made by you without giving reasons, including

         but limited to an error in the advertised price for, the description of, the products on the website, or error in your Order.

3.6    Aussie Fleece has sole and absolute discretion to accept or reject any Order or offer made by you without giving reasons, including

         but limited to an error in the advertised price for, the description of, the products on the website, or error in your Order.

3.7    Stock availability is subject to change and any representation concerning stock availability is accurate to the last known stock level. If

         a product cannot be supplied, Aussie Fleece will notify you by telephone or email as soon as possible.

3.8    Your Order is fulfilled on the issue to you by email of a tax invoice for the sale and the shipment of product.

3.9    Products advertised, as “Pre Order” during the initial ordering process cannot be canceled.

3.10  Pre Order dates may change without notice due to unforeseen circumstances or delays caused by issues with suppliers.

3.11  If the Pre Order delivery date changes after you have placed your Order, you can either keep the Order or cancel the Order.

         Products advertised with a Pre Order date of “TBA” ( to be announced) can either be kept or requested to be cancel provided the

         product has not been shipped out.

4. ORDERS FOR COLLECTION AT AN AUSSIE FLEECE STORE

4.1    If you wish to collect your Order from an Aussie Fleece store you will be prompted to select whether you wish to collect your Order

         or to have it delivered to your address.

4.2    A representative of the relevant Aussie Fleece store will contact you to notify you when the Order is available for collection;

4.3    Orders for collection must be collected from the nominated store within 7 days of notification by Aussie Fleece representative that

         the Order is ready for collection.

4.4    If the order is not collected within 7 days, the product will be reordered for you but if the Order is not subsequently collected, you

         agree that the Order will be cancelled and your payment will be retained by Aussie Fleece as compensation for ordering and

         handling expenses.

4.5    When collecting your Order, you must provide proof of identity namely a driver’s license or photo ID.

5. TITLE & RISK

5.1    Title and risk in the product passes to you on delivery or collection as the case may be.

5.2    To the extent permitted by law, Aussie Fleece is excluded from any liability whatsoever and howsoever caused to you or any third

         party for loss and damage arising from your use of the Aussie Fleece website including but not limited to loss and damage you

         might suffer arising from:

i.     Errors and mistakes or inaccuracies in the website;

ii.    You acting or not acting on any information contained in the website and/or any linked website;

iii.   Any unauthorized access to or use of the website secure servers;

iv.   Any interruption or cessation of transmission to or from the website;

v.    Any virus, bug Trojan horse or other harmful code or communication which may have infected the website or linked website or

       transmitted from your website by any third party;

vii.  The quality or fitness for purpose of the website;

viii. Unless otherwise provided in these terms, and to fullest extent allowed by law, Aussie Fleece and its representatives or third

       parties will not be directly or indirectly liable for any damages however caused arising out of the use by you of the website;You

       will indemnify and keep indemnified Aussie Fleece its directors, officers, servants, employees and agents from and against all

       loss (including reasonable legal costs on an indemnity basis) or liability incurred or suffered by you or by Aussie Fleece its  

       directors employees officers servants or agents arising from any claim demand, suit or action by any person against you or them

       where the loss or liability arose from or was in connection with your conduct or breach of these terms.

ix.   The customer agrees to use the product at the risk of the customer and hereby releases to the full extent permitted by law

       Aussie Fleece (except to the extent that the same is caused or contributed to by any act omission or the negligence of Aussie

       Fleece) from all claims, demand, and suits of every kind and from all liabilities whatsoever which may arise in respect of any

       accidents loss or damage to property or death of or injury to the customer or any person who through the customer uses the

       product of whatsoever nature or kind whether latent or patent and whether the existence of any latent or patent defect in the

       product or dangerous state of affairs was or ought to have been known to Aussie Fleece or not and the customer agrees that

       (save as aforesaid) Aussie Fleece shall have no responsibility or liability for any loss of or damage to the customer or the   

       customers personal property or for the death or personal injury of or damage to the personal property of any third person to

       whom the customer has given or allowed to use the product.

6. CREDIT FRAUD

6.1    The website uses NAB transact & Square payment gateway to secure payments. To the extent permitted by law, Aussie Fleece will    

         not be responsible for any direct or indirect damage or loss suffered by a user where a credit card is

         fraudulently used or used in an unauthorized manner.
